Rental agreement = document or contract signed by the client when picking the car up together with these terms and general conditions document.

Client, customer or lesee will be used to designate the main driver and person signing the rental agreement.

Any unauthorised use of the car or against these rental terms and conditions will entitle YELLOW CAR for an early rental agreement cancellation.

RATES AND RESERVATIONS

The rates shown in our web page are only valid for online reservations (online rate). Rates offered in our offices or collaborator locations might differ from the online rate and be subject to different terms and conditions.

Rates include:

V.A.T and taxes.

Unlimited millage within Andalucía.

Full risk insurance with no excess as detailed in bellow in these terms and conditions document.

No reservation is confirmed with reference to any specific vehicle make, model, colour, accessories, etc. Only a car group (with vehicles with similar characteristics) is confirmed.

RENTAL PERIOD AND EXTENSIONS

Customers receive the rental vehicle described in the rental agreement in perfect working order, with all its documents, tires, tools and accessories,

Rental days are computed in 24-hour periods.

The vehicle must be returned at the exact date, time and place shown in the rental agreement.

A courtesy period for returning the vehicle of 2 hours after the ending time is allowed. After this time the corresponding additional rental days will be charged according to the applied tariff

Any car rental where no compulsory deposit or prepayment has been requested can be terminated in advance by the client. The proportional amount paid for the days the vehicle was not used will be refund.

For an extension of the rental period clients must go to any Yellow Car office to sign an extension document at least 24 hours before the ending date of the contract. Agreements cannot be extended by phone or by any other means of electronic communication.

If the rental agreement cannot be extended (because no vehicles are available or for any other reason), customers must return the vehicle on the agreed date, time and place.

A unilateral extension of the agreement by customers will be considered illicit use of the vehicle, and the insurance coverage will be automatically cancelled.

DRIVER AND LESEE AGE AND DOCUMENTS

The lessee and any other authorised driver must present the following documents when receiving the vehicle:

– A valid driving license.

Driver’s licences from non-european countries are accepted. If printed with non-roman alphabet (arabic, chinese, cyrillic) must be together with a valid international driving licence.

– An identity card or passport.

– A valid credit card Visa or Mastercard.

– For Malaga Airport reservations we might request a valid flight number before accepting the reservation.

AGE RESTRICTIONS

The minimum drivers age is 21 years old with possession of a driving license for at least 2 years.

Drivers between 21 and 23 years old will pay an additional insurance cost of 10 € per rental day with a maximum of 140 € per booking

These young drivers are only allowed to hire the following car groups: A, A0, C and G

A Driver older than 25 years old holding at least a 4 years old driving license will be requested for the following car groups: J, J0,J1, J2, K1, K2, R

Age limit for any driver will be 79 years old

PAYMENT METHODS

Payment must be made with credit card VISA or MASTERCARD

American Express and Dinners Club cards are not accepted.

The credit card must be issued in the name of the client or any other person present at the at the time of vehicle pick-up.

If the card is not issued in the name of the client, the card holder will also sign and accept the rental agreement

Client, additional authorised drivers or any person signing the rental contract are joint and several responsible for the obligations and terms of the rental agreement that are applicable.

We reserve the right to cancel the delivery of the vehicle in the following cases:

– Doubts about the financial capacity of the client, the validity of the presented documentation or credit card.

– Outstanding debts of the clients or any associated drivers.

– Clear evidence that the driver is not in physical conditions for a safe driving.

– Any serious incident with Yellow Car or staff.

A deposit in cash or with credit/debit card can be set under these circumstances.

BOOKING CANCELATIONS AND PREPAYMENT

With the exception of some high-end cars for specific dates you can pay your car when

picking it up and an advance payment will not be requested.

You will be able cancel your reservation at any time prior to car pickup

In case your reservation has a non-cancellation period, a deposit or full payment might be requested in advance. You will be informed about this circumstance before you confirm your reservation.

Any prepaid amount will be kept by Yellow Car as compensation if the booking is cancelled within the non-cancellation period.

INSURANCE CONDITIONS

Yellow Car provides a full risk insurance with no excess with the following coverage:

a) THIRD PARTY INSURANCE. This is the compulsory insurance with an extension of supplementary civil liability as stated in Spanish law. It protects the Lessee against damages caused to people and things outside the car and also to car passengers excluded the driver

The insurance policy’s general and particular clauses are available to customers on request.

b) C.D.W (Collision Damage Waiver). Protects the renter against liability to Yellow Car for the cost of repairing or replacing the rental vehicle and its parts or accessories if damaged during the rental period (provided the vehicle is used in accordance with the terms of the rental agreement). This protection extends to 100% of the damages cost without any amount to be paid by the client as a partial responsibility (excess).

Our insurance includes:

– Punctures or damage to the tires, wheels and underside of the vehicle.

– Broken mirrors, windscreens and car windows.

– 24 hours tow assistance service.

– Vehicle replacement in case of breakdown or accident.

– 24-hour taxi service for a first urgent trip in case of breakdown or accident.

c) T.P.I. (Theft Protection Insurance). Protects the renter against liability to Yellow Car for the loss or theft of the vehicle and its parts or accessories (provided the vehicle is used in accordance with the terms of the rental agreement). This protection extends to 100% of the car value without any amount to be paid by the client as a partial responsibility (excess).

d) P.A.I (Personal Accident insurance). Provides cover to the driver for death, permanent disability or medical expenses occurring as a result of an accident caused by himself, up to the following amounts:
Death, permanent disability … 6.000 €
Medical assistance … 1.800 €

Lost of private belongings left into the car are not covered by the insurance in the event of accident or theft.

All insurance protection will become void for accidents, damages or car lost in the following circumstances:

– When the vehicle is used after the rental period end date stated in the rental agreement.

– While the car is being driven by unauthorized driver or by a driver not possessing a valid licence at the time of the event. All drivers not explicitly stated in the car hire contract will be considered unauthorized drivers

– While driving under the influence of alcohol, medicines or drugs.

– While transporting a number of passengers higher than authorised for the vehicle.

– While using the car for the transport of dangerous goods.

– Use of the car off-road or non-paved roads closed to public traffic.

– Pushing or towing another vehicle.

– The transport of individuals or goods subject to direct or indirect payment.

– Using the vehicle for unlawful activities or driving against the traffic regulations.

– Driving outside the community of Andalucía when not expressly allowed in the rental agreement

FREE ROADSIDE ASSISTANCE & TAXI SERVICE 24 HOURS

In case of accident of breakdown our insurance will take care of car towing without any cost by your side.

They will also provide you with a free taxi, or alternative transportation option, for a first urgent trip.

The road assistance can also help you in the following situations:

– Jump starting a dead battery

– Delivering emergency fuel (cost of fuel not included).

– Changing a flat tire if you do not want to do it yourself

– Car stuck, for instance in sand.

All services may only be ordered by a direct claim to the Roadside Assistance telephone number indicated either on the rental contract or the key label.

GEOGRAFIC RESTRICTIONS

In order to benefit from our special web rates, the vehicle is restricted to travel out of Andalucía.

Driving into Gibraltar is accepted.

Please check rates with us if willing to travel out of this area.

FUEL SYSTEM

To avoid any fuel charge we deliver all vehicles with a full tank of fuel and they have to be returned the same. Full à Full

If not returned full, the missing fuel plus a refilling supplement will be charged as follows (rounded to the closer quarter)

Empty 100 € ¼ tank 75 € ½ tank 50 € ¾ tank 25€ Full (no charge)

Before refilling the car it is the client´s responsibility to verify which is the correct type of fuel.

In case of refilling the car with an incorrect type of fuel (diesel in case of petrol or vice versa) the client will have to pay the amount of 150 € in concept of fuel and repair costs

EXTRAS AND ACCESORIES

This is the cost of additional extras and accessories.

Portable GPS Navigation system

5 € per day with a maximum of 50 €

Additional authorised driver

3 € per day with a minimum of 10 € and a maximum of 40 €

Child seats, maxicossi and high back booster seats

7 € per day with a minimum of 20 € and a maximum of 49 €

Basic booster seat

3 € per day with a minimum of 10 € and a maximum of 21 €

Delivery and collection at private address or Hotel.

With previous agreement this service is available with no extra cost at locations situated within a distance range to our offices

A fee of 20 € is set for further locations.

Car pick up out office opening hours at Malaga Airport

Malaga airport pickups between 22:00 and 2:00 have an additional cost of 20 €

Malaga airport pickups between 2:00 and 8:00 have an additional cost of 30 €

Car pick up or return at Train Station Maria Zambrano (MALAGA)

There is a supplement of 20€ per service

The following costs may arise during your reservation:

Traffic Fines

We do not charge any administration fee for traffic fines.

Wrong vehicle refuelling.

In case of refilling the car with an incorrect type of fuel (eg. Petrol instead of diesel or vice versa) the client will have to pay the amount of 150 e in concept of fuel and repair costs.

Special Cleaning.

If the car needs a special cleaning service due to excessive dirt, dirty upholstery, pets hair or droppings,etc an additional cleaning supplement of 100 € might be charged.

Wrong Malaga Airport Return.

Car return at Malaga Airport at a different location than indicated when picking the car up might have an additional charge of 50 €

Lost car keys

Will have a replacement cost of 200 €

FAILURE TO RETURN THE VEHICLE

Failure to return the vehicle on the date and time set out in the rental agreement authorises Yellow Car to charge the client, according to the rate already applied, for every day elapsed until the final return or recuperation of the car.

Returning or abandoning the vehicle in a place other than the one indicated in the rental contract will entitle Yellow Car to charge the client:

– The price of the rental days needed to retrieve the vehicle and return it to its pre-rental condition so it can be hired again.

– Damages present in the car. They will be considered produced after the rental ending day if they have not been reported to Yellow Car by the client.

– The client will be responsible for all the costs involved in the vehicle recuperation such us, tolls, safekeeping, staff transport and expenses, etc

In the event that the vehicle disappears or is not returned we reserve the right to undertake legal actions against the customer.

CAR CLEANING

Yellow Car will assume without cost the cleaning of the vehicle produced by a normal regular use.

It is allowed to transport pets in the back seats of the car as long as a special protection cover is used.

At client request we can provide special seat covers without any charge while available.

If the car needs a special cleaning service due to excessive dirt, upholstery stains, pets hair or droppings,etc an additional cleaning supplement of 100 € might be charged.

We appreciate your collaboration in not using the car with wet bathing suits or any other wet garments as chlorine and salt can cause unrepairable stains to the car´s upholstery.

LOST CAR KEYS

Lost car keys will have a cost of 200 €

Accidentally introducing an electronic key in water such as a pool or sea will permanently damage the key and will have the consideration of a lost key

NO ADMINISTRATION FEE FOR TRAFFIC FINES

When traffic fines are not paid on the spot, the car owner becomes the recipient of the notifications. It is our obligation to identify to the traffic authorities who the car driver was. This involves and administrative work and some car hire companies charge for it.

Yellow Car does not charge any fee for the administration of traffic fines.

WHAT TO DO IN CASE OF AN ACCIDENT

In case of an accident with another vehicle it is the client´s obligation to fully complete an accident report form (either the ‘Declaración Amistosa de Accidente’ (A Friendly Accident Report form can be found in the glove compartment of your car) or the ‘Informe de Siniestro’ (Accident Report provided by police authorities when present)

The report form has to be presented to Yellow Car as soon as possible and always in the next 48 hours after the accident.

The form has to include the following minimum information: date, location and time of the accident; registration plate number and model of contrary cars involved; name and telephone of the contrary driver;

When possible make pictures of the cars and accident positions.

In case of any doubt we recommend you to call the police (Tlf 112) who will help you manage the accident.

Yellow Car reserves the right to charge the client for damages caused to the vehicle in the event of an accident in the following circumstances:

– When the vehicle was not used according to these terms and conditions.

– An accident report form was not completed or sent to Yellow Car within 48 hours.

Damages amount will be calculated according to the estimate provided by an external official garage of the car make (Opel, Ford, Fiat, etc) in the Province of Malaga. The customer can provide another estimate from any other official garage of the car make in the Province and the lowest one will be accepted by Yellow Car.

In any case client´s liability will not exceed the vehicle’s market value, according to Ganvam guide at the time of the accident.

The client authorizes to be charged on the credit card used for the rental payment for this concept.

In case of accident clients will not abandon the hired vehicle without taking needed measures to safeguard it. We provide a free road assistance service for this.

In the event of theft or disappearance of the vehicle, customers will notify Yellow car immediately and will report the issue to police authorities, sending a copy of the official report “DENUNCIA” to Yellow car

GPS

For security reasons some cars are equipped with GPS locators. Location data will only be accessed in the event of car theft, accident alert or when the vehicle is not returned at the agreed date and time.

The customer knows and accepts this fact and agree not to make any action tending to avoid proper function of the GPS system

COMPULSORY CHILD SEATS RESTRAINTS

Children under three years of age or under 1.5 metres height will require an special seat that can be provided for a fee.

Customers are responsible for installing any child seat.
